These Terms of Use (hereinafter, the “Terms”) set forth the conditions governing use of the iOS/Android mobile application (hereinafter, the “App”) provided by Kioku LLC (hereinafter, the “Operating Company”). Please read these Terms carefully and use the App only if you agree to them. By installing or using the App, you (hereinafter, the “User”) are deemed to have agreed to these Terms.

1. Scope

  1. These Terms establish the conditions for the services (collectively, the “Services”) offered through the App, as well as the rights and obligations between the Operating Company and the User. They apply to all relationships between the User and the Operating Company regarding use of the Services.
  2. If you do not agree to these Terms, please uninstall the App and discontinue any further use.

2. Eligibility

Only individuals who meet all of the following requirements may use the App:

  1. Those who agree to and comply with these Terms.
  2. Those who have not violated these Terms in the past.

3. Prohibited Conduct

When using the App or the Services, Users must refrain from:

  1. Violating any laws or public order and morals.
  2. Engaging in activities related to criminal behavior.
  3. Acting in contradiction of any court rulings or orders.
  4. Impersonating any individual or entity.
  5. Collecting personal information or similar data of others by any improper means.
  6. Making false statements or otherwise deceiving others.
  7. Transferring or lending to a third party any authentication information obtained through the App.
  8. Engaging in spam-like behavior (repeatedly posting identical content or posting with the intent to redirect to another app or website).
  9. Intentionally interfering with the servers or network systems that support the Services.
  10. Obstructing or attempting to obstruct the operation of the Services.
  11. Repeatedly accessing the API server directly without using the App’s officially provided methods.
  12. Offering direct or indirect benefits to antisocial forces.
  13. Infringing on the intellectual property rights, portrait rights, privacy, reputation, or other rights of other Users, the Operating Company, or third parties.
  14. Posting content deemed inappropriate, including but not limited to:
    • Excessive violence
    • Explicit sexual content
    • Discriminatory expressions based on race, nationality, creed, gender, social status, or family origin
    • Content that encourages suicide, self-harm, or the improper use of drugs
    • Any other expression that may cause discomfort or offense
  15. Harassment, defamation, stalking, or any other act that harms another individual.
  16. Seeking to meet or date strangers of the opposite sex.
  17. Conducting religious activities or soliciting members for a religious group.
  18. Any other conduct deemed inappropriate by the Operating Company or equivalent in nature to the above.

If the Operating Company determines that a User’s behavior falls under any of the above, it may remove relevant content or suspend or delete the User’s account. The Operating Company is under no obligation to disclose the reasons for taking such actions.

4. Management of Authentication Information

  1. Users bear sole responsibility for appropriately managing and safeguarding their authentication information (hereinafter, “Authentication Information”), such as email addresses and passwords, used to access the App.
  2. If a User loses access to their registered account information, they may be unable to log in to the App.
  3. When registering for the App using external services (hereinafter, “External Services”) provided by entities other than the Operating Company, Users must abide by the applicable terms of those External Services and assume full responsibility for their use.
  4. The Operating Company shall not be liable for any damages arising from the User’s inadequate management of Authentication Information or the unauthorized use of such information by third parties.

5. Paid Features and Payment

  1. The App may offer paid plans, which provide access to exclusive features upon payment of a specified monthly fee.
  2. Unless the User cancels the plan by completing the required cancellation procedure at least one day before the end of the contract period, the plan will automatically renew for an additional month, and the User will be obligated to pay the monthly fee from the day after the prior period’s expiration.
  3. If the User’s payment fails at the time of renewal, the Operating Company may immediately suspend the paid plan without incurring any liability for damages resulting from such suspension.
  4. Each paid plan is treated as a separate contract for each operating system (Android or iOS) on which the App is installed. In the event of switching between operating systems, such contracts cannot be transferred.
  5. This app may offer a free trial period for first-time users. No charges will be incurred during the free trial period; however, if the required cancellation process is not completed at least 24 hours before the free trial period ends, your subscription will automatically transition to the regular paid plan, and the fee for the next subscription period will be automatically charged on the subscription start date.

6. Changes to the Services

The Operating Company may, without notice, alter the content of the App or cease offering certain features. The Operating Company assumes no responsibility for any damages or disadvantages Users may incur as a result of such changes or suspensions.

7. Disclaimer

  1. The Operating Company makes no explicit or implied warranty that the App and Services are free from factual or legal defects (including, but not limited to, safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, or infringement of rights).
  2. The Operating Company shall not be liable for any damages or losses arising from the use of the App. However, if the contract between the Operating Company and the User qualifies as a “Consumer Contract” under the Consumer Contract Act, certain disclaimers may not apply.

8. Revisions to These Terms

  1. The Operating Company reserves the right to revise these Terms by providing notice to Users or by posting the changes within the App or on associated websites.
  2. The Operating Company shall not be liable for any damages or losses arising from changes to these Terms or to the content of the App.

9. Governing Law and Jurisdiction

  1. These Terms shall be interpreted in accordance with the laws of Japan.
  2. In the event of any dispute arising in connection with the App, the court that has jurisdiction over the Operating Company’s principal office shall have exclusive jurisdiction as the court of first instance.

  4. Responding to Inquiries. Addressing any questions or issues you may have regarding the App.

  7. Other Legitimate Business Purposes. Carrying out any other purpose described when the information is collected or when you provide consent.

Where permitted by law, we may charge a reasonable fee for access, correction, or other requests. We will notify you of any fee before proceeding with your request.

We take reasonable measures to safeguard your information, including administrative, technical, and physical protections. However, no security system is completely infallible, and we cannot guarantee absolute security.

7. Children’s Privacy

This App is not directed at children under 13. We do not knowingly collect Personal Information from anyone under 13 without parental consent. If you believe we have collected information from a child under 13, please contact us so we can address the issue promptly.

8. Changes to This Privacy Policy

We reserve the right to update or modify this Privacy Policy at any time. If we make material changes, we will notify you by posting the revised policy in the App or through other appropriate means. By continuing to use the App after the changes become effective, you agree to the updated policy.
